| The Voice of Subcontractors is being heard. ASA-MN is maximizing its time with elected officials and candidates to establish the association as ‘the voice of subcontractors,’ talkng about the importance of advancing policy supporting subcontractors. We are working to secure a place at the table for all future debates involving the construction industry.
ASA-MN is promoting three policy changes to improve the business climate for subcontractors. Two of these changes are found in SF 2163 (Sheid, D-Brooklyn Park) / HF 2393 (Nelson, D-Brooklyn Park). The other change is found in SF 3057 (Murphy, D-Red Wing). The requested changes:
* Paid-if-Paid. Makes paid-if-paid contract clauses unenforceable (SF 2163 / HF 2393)
* Loan in Default. Requires lenders to inform prime contractors and subcontractors when the construction loan is in default (SF 2163 / HF 2393)
* Retainage. Requires retainage to be placed in an interest-bearing escrow account with a third party to be released upon substantial completion of the work (SF 3057)
